Competition terms

For competitions, prize draws and campaigns run through this website, the newsletter or the linked social media profiles.

1. Preliminary note

The organiser is Digital Wings GmbH, Gettsdorf 112, 3710 Ziersdorf, Austria, represented by Ing. Florian Hieß, MSc and Romana Hieß (the "organiser"). Participation is only possible under these terms and implies acceptance of them.

Differing or additional details in the respective announcement. Such as period, prize or entry route. Take precedence over these general terms.

2. Participation and eligibility

2.1 The competition is in no way connected to Meta, Instagram, LinkedIn, X or any other platform. These companies are neither organiser nor sponsor and are not available for its administration. Any claims relating to the competition must be directed solely at the organiser.

2.2 Participation is free of charge, voluntary and not tied to any purchase.

2.3 Eligible are natural persons aged 18 or over resident in Austria, Germany or Switzerland. Participation is permitted in one's own name only.

2.4 Entry is made via the route stated in the respective announcement, for example a form or a comment on a social media profile. One entry per person, unless stated otherwise.

2.5 Participants agree to be named if they win, and that submitted contributions. Such as comments or answers. May be published as part of the campaign.

2.6 The organiser reserves the right to end, suspend or amend a competition at any time without giving reasons, in particular where proper administration cannot be ensured for technical or legal reasons.

3. Exclusion from the competition

Excluded from the competition are:

  • employees of the organiser and their relatives
  • persons who breach these terms
  • entries using automated methods, multiple accounts or any other manipulation
  • entries with incomplete or incorrect information
  • contributions breaching platform policies, applicable Austrian law or public decency

Exclusion may also occur retrospectively. In that case a prize already awarded may be reclaimed.

4. Prize handling

4.1 Unless announced otherwise, winners are drawn at random within 14 days of the end of the entry period.

4.2 Notification is sent via the channel given at entry, usually email or direct message, with a request for confirmation.

4.3 If no reply is received within two weeks, the claim to the prize lapses and the organiser may draw again.

4.4 Cash payment, exchange or transfer of the prize to third parties is not possible.

4.5 Shipping costs within the stated countries are borne by the organiser. Any additional costs and any taxation of the prize are borne by the winner.

5. Transfer of rights of use and publication

5.1 Participants confirm that they are the author of all submitted content, in particular text and images. Or hold the necessary rights.

5.2 By submitting, participants grant the organiser the non-exclusive right, unlimited in time and territory, to publish the contribution in whole or in part in connection with the campaign, in particular on this website and the linked social media profiles.

5.3 No remuneration is owed for this.

6. Indemnification

Participants are liable for infringements of third-party rights, in particular trade mark, copyright and personality rights, as well as for defamatory or untrue content. Should third parties assert claims against the organiser, participants indemnify and hold him harmless.

7. Data protection

7.1 Personal data provided on entry is processed solely to run and administer the competition.

7.2 The legal basis is Art. 6(1)(b) GDPR, as processing is necessary to perform the relationship established by entry. Publication of the name additionally relies on consent under Art. 6(1)(a) GDPR, which may be withdrawn at any time.

7.3 Data is passed to third parties only where necessary for administration, for example to a shipping company to deliver the prize.

7.4 Data is deleted once the competition has concluded. For physical prizes, the winner's data is retained for the duration of any warranty claims. Statutory retention periods remain unaffected.

7.5 All further details, in particular on data subject rights and the competent supervisory authority, are set out in the privacy policy.

8. Liability

8.1 The organiser is not liable for technical faults, delays or outages beyond his control, nor for manipulation attempts by third parties.

8.2 Liability is limited to intent and gross negligence. Liability for slight negligence is excluded, except for personal injury.

8.3 On handover of the prize the organiser is released from all further obligations. Defects in the prize are subject to claims against the respective manufacturer or supplier.

9. Applicable law and jurisdiction

9.1 Austrian substantive law applies exclusively, excluding its conflict-of-law rules.

9.2 The place of jurisdiction is the organiser's registered office, unless mandatory consumer protection provisions apply. For consumers, the statutory jurisdiction applies.

9.3 Recourse to the courts regarding the draw itself is excluded.

10. Final provisions

Should any provision of these terms be invalid, the remaining provisions remain unaffected. The invalid provision is replaced by a valid one closest to the intended purpose.
